Revise Online Access Plan Terms

This document (which is referred to as the Access Plan Terms) contains important details about any Revise Online Access Plan you purchase from us, such as:

  1. How long your access will last;
  2. How to pay for your access; and
  3. How you can cancel your access.

Some terms are capitalised in these Access Plan Terms. This means that they have a defined meaning, and we have explained words used throughout the Access Plan Terms in the glossary below for easy reference.

Glossary

“Acceptable Use Policy” is the policy that governs your use of Pearson services here;

“3 Month Access Plan” means a fixed term access period of 3 months, which is paid upfront;

“6 Month Access Plan” means a fixed term access period of 6 months, which is paid upfront;

“12 Month Access Plan” means a fixed term access period of 12 months, which is paid upfront;

“Payment Methods” means the payment methods set out in Section 4.2;

“Pearson” “we” or “us” means Pearson Education Limited and its group companies;

“Refund Period” means 14 days after the date of starting your Access Plan;

“Revise Online Services” means the education content provided as part of your Access Plan;

“Revise Online Terms of Use” means important details about your access to the Services here;

“Start Date” means the date you receive confirmation from us that your Access Plan has started;

“Access Plan” means your paid for access to the Revise Online Services, including a 3 Month Access Plan, 6 Month Access Plan and/or an 12 Month Access Plan; and

“Supported Device” means Internet-connected mobile devices, desktop computers, and other supported devices.

By purchasing a Access Plan on the Revise Online website, you agree to these Access Plan Terms, which, once you receive a confirmation email from us, creates a binding contract between Pearson Education Limited. and its group companies and you.

During the term of your Access Plan, you will receive access to the Revise Online Services on Supported Devices.

By agreeing to these Access Plan Terms, you also agree to the Revise Online Terms of Use although you do not need to register for a separate user account. We’ve tried to ensure that these Access Plan Terms and the Revise Online Terms of Use are consistent, but if there is any conflict between them relating to your use of the Revise Online Services, these Access Plan Terms will take priority.

1 Data Privacy, Collection & Use

Pearson's data collection and use practices for the Revise Online Services are explained in the privacy policy. We will collect, process, and use your personal information in accordance with this policy.

2 Your Access Plan

2.1 By purchasing a Access Plan, you agree that you are over 18 years old. If you are under 18, please ask your parent or guardian to purchase the Access Plan instead.

2.2 You can select a 3 Month, 6 Month or an 12 Month Access Plan.

2.3 Your Access Plan begins on the date you receive confirmation from us, and will be billed upfront.

2.4 If you have purchased:

(A) a 3 Month Access Plan, your Access Plan will run for 3month from the Start Date and then terminate.

(B) a 6 Month Access Plan, your Access Plan will run for 6 month from the Start Date and then terminate.

(C) a 12 Month Access Plan, your Access Plan will run for 12 month from the Start Date and then terminate.

Details regarding your Access Plan term and status can be viewed and managed in your account settings. To use the Revise Online Services you must have Internet access and a Supported Device and provide us with one or more Payment Methods as described below in the Payment, Billing, & Price Changes Section below.

3 Promotional Offers

3.1 We can offer you special deals or promotions for Pearson.

3.2 Through the Revise Online Services, we may from time to time provide you with promotional offers, plans, or subscriptions for additional products or services from Pearson or third parties. If a Pearson-provided offer mistakenly lists an incorrect price or offer term, Pearson can refuse or cancel any orders placed for the offered product or service, whether or not the order has been confirmed and whether or not you have been charged for such offer, product, or service.

4 Payment

You can pay with your credit card or debit card.

4.2 Payment Methods. You may pay for your Access Plan using a valid Visa, MasterCard, Maestro UK or Visa Electron credit card or debit card - each a Payment Method. You agree that your selected Payment Method will be charged by Pearson when you purchase. You agree to pay all amounts due at the time you place your order. Confirmation of your order will be sent to the email address on file for your account.

5 Cancellation, Refunds & Credits

5.1 You can cancel your Access Plan by following the steps set out below.

5.2 Legal Right to Cancel. You can contact us within 14 days of starting your Access Plan to cancel your Plan and receive a refund as follows: to exercise your right to cancel, you can contact us during the same period to let us know you would like to cancel and refund. The Access Plan starts immediately after your purchase as requested by you at the time of purchase (by clicking the relevant box before payment). If you have used your Access Plan during the 14-day cancellation period before contacting us to cancel your Access Plan, you must pay us the amount proportionate to the services supplied before cancellation.

5.3 After the Refund Period (except where you are entitled under law) your Access Plan fee is non-refundable and Pearson will not provide a refund or credit for partially used Access Plan. If you have any problems with the Services or your Access Plan, please contact us here.

5.4 If you cancel and refund your Access Plan, your access to the Revise Online Service will end on that day.

5.5 Credits. At any time, and for any reason, we may provide a refund, discount, or other consideration to some or all our customers. The amount and form of such credits, and the decision to provide them, are at our sole and absolute discretion.

6 Service, Device, & Content Limitations

6.1 Your Access Plan to use and enjoy Revise Online comes with some limitations.

6.2 As set out in the Revise Online Terms of Use, your use of the Revise Online Services is subject to Pearson’s Acceptable Use Policy. By accessing or using the Revise Online Services you agree to comply with the terms of the Acceptable Use Policy. As described on the Revise Online website, device and download limitations also apply. The number and type of Supported Devices that may be used to access the Revise Online Services is limited, as are the number of downloads of Revise Online Content for offline consumption via mobile apps (web-based downloads are not available). Notice of changes will be posted on the Revise Online website. Additionally, Revise Online content is regularly updated. We may add or remove content from the Revise Online Services, provided that such changes do not materially affect the user experience.

6.3 We may suspend or terminate your Access Plan if you are in serious breach of these Access Plan Terms and/or the Acceptable Use Policy.

7 Our responsibility to you

7.1 We will always be responsible to you for the following: (a) death or personal injury arising as a result of our negligence; (b) fraud; or (c) any other liability that cannot be excluded or limited under applicable law.

7.2 Other than explained in Section 7.1, we are not responsible to you for any damages, losses or costs relating to your use of the Revise Online Services in a way that isn’t permitted under these Access Plan Terms.

7.3 Otherwise, we are only responsible to you for any damages, losses or costs which result from us not performing our obligations under these Access Plan Terms and which could have been reasonably foreseen by us and you when entering into these Access Plan Terms.

9 Changes to these Access Plan Terms

9.1 We may occasionally need to update these Access Plan Terms.

9.2 We will provide you with at least 7 days’ notice before the new Terms become effective, unless a change is needed by law or for emergency reasons. If you are not happy with the updated Access Plan Terms, please do not continue to use or access your Access Plan.– further details are set out in Section 4.5. 10 Other important terms

10.1 Each section of these Access Plan Terms operates separately. If any court or relevant authority decides that any of them are unlawful or unenforceable, the remaining clauses will remain in full force and effect.

10.2 If we fail to insist that you perform any of your obligations under these Access Plan Terms, or if we do not enforce our rights against you, or if we delay in doing so, that will not mean that we have waived our rights against you and will not mean that you do not have to comply with those obligations. If we do waive a default by you, we will only do so in writing, and that will not mean that we will automatically waive any later default by you.

10.3 We can transfer our contract with you under these Access Plan Terms to another company, provided that this does not affect the standard of the Revise Online Services which are provided to you.

10.4 These Access Plan Terms are governed by the law of England and Wales. This means that your access to and use of the Revise Online Services, your purchasing of Access Plan, and any dispute or claim arising out of or in connection therewith (including non-contractual disputes or claims) will be governed by the law of England and Wales.

10.5 You may bring any dispute which may arise under these Access Plan Terms, at your discretion, either the competent court of England and Wales, or to the competent court of your country of habitual residence if this country of habitual residence is within the UK, which courts are (with the exclusion of any other court) competent to settle any of such a dispute. We shall bring any dispute which may arise under these Access Plan Terms to the competent court of your country of habitual residence if this is within the UK or otherwise the competent court of England and Wales.
